About this policy

Shaksham Law Associates is a law firm based in Anamnagar, Kathmandu, Nepal. This policy applies to information received through slawnepal.com, including information provided through forms, email and other means of contacting the firm through the website.

This policy concerns the operation of the website and the information received through it. It does not replace the professional duties of confidentiality, legal privilege or any other obligations that may apply to the firm in relation to an actual client or legal matter.

The website is currently available in English. A Nepali version is being prepared and will be published separately. Until then, the English version is the operative version of this policy.

Information received through the website

The website is designed to collect only the information necessary for the purposes for which you provide it.

When you use the consultation booking form, pro bono request form or careers form, the information you enter may include your name, email address, telephone number, details of your enquiry and any documents you choose to attach.

These forms submit directly from your browser to a script operated by the firm within its own Google account. The details you enter are recorded in a spreadsheet held in that account, any documents you attach are stored in the firm's Google Drive, and a notification is sent to the firm's email address. This website does not itself operate a database and does not retain the information.

The website also stores certain preferences, such as language and accessibility settings, in your browser's local storage. These settings remain on your device and are not sent to or stored by Shaksham Law Associates.

Third party services

Certain features of the website are provided through third party services.

The contact page uses an embedded Google Maps service, and the website uses Google Fonts. When these services are loaded, your browser may make a direct connection to Google's servers. Google may process information associated with those requests in accordance with its own policies.

In addition, the firm uses Google services, including Google Drive, Google Sheets and Google Apps Script, to receive and hold information submitted through the website's forms. Information you submit through those forms is therefore processed by Google in the course of providing those services to the firm.

Shaksham Law Associates does not control the information collected by these third party services. If you do not wish to make such connections, you may be able to prevent them through your browser settings or appropriate content blocking tools. The principal content of this website remains available without these services.

Website logs and tracking

The hosting provider may maintain ordinary technical logs recording access to the website. Such logs may include information ordinarily generated when a web page is requested, such as an IP address, browser information and the time of access.

We do not use these logs to create individual profiles.

The website does not use advertising pixels, behavioural advertising or tracking cookies operated by Shaksham Law Associates. We do not operate a separate analytics system on the website.

If the way information is collected or used changes materially, this policy will be updated accordingly.

How we use information

Information received through the website may be used to:

• respond to an enquiry or request;
• determine whether the firm may be able to assist with a matter;
• carry out appropriate conflict checks;
• communicate with a prospective or existing client;
• provide legal services where the firm has agreed to act;
• consider applications for employment, internships or other opportunities; and
• comply with applicable legal and professional obligations.

Information provided for employment or career opportunities is used for the purpose of assessing the relevant application and managing the recruitment process.

We do not sell personal information or provide it to third parties for their own marketing purposes.

Information concerning legal matters

Please take care when sending information about a legal matter through the website.

Submitting an enquiry does not, by itself, make you a client of Shaksham Law Associates and does not establish a lawyer client relationship. Until the firm has confirmed that it has accepted the instruction, you should not assume that information sent to us will receive the same protections that apply to communications within an established professional relationship.

Electronic submission also carries inherent security risks. If your enquiry involves highly sensitive information, please contact the firm by telephone at +977 984 3625565 and discuss an appropriate way of providing the information.

You should also avoid sending documents or information that are not necessary for us to understand the nature of your enquiry at the initial stage.

Disclosure of information

Information received by the firm is ordinarily accessible only to those advocates and staff who require it for a legitimate professional or administrative purpose.

We may disclose information where disclosure is required or permitted by applicable law, including where necessary to comply with a court order or a requirement of a competent authority.

Information may also be shared with another professional or service provider where this is reasonably necessary in connection with a matter and is consistent with our professional and legal obligations. Where appropriate, this will be discussed with the client.

We may also disclose information where necessary to establish, exercise or defend a legal claim.

The firm's email and other technical systems may be provided or supported by third party service providers. As a result, information contained in emails may be processed by those providers in the ordinary course of providing their services.

Retention of information

The period for which information is retained depends on its nature and the reason for which it was collected.

Records relating to client matters are retained in accordance with the firm's professional and legal obligations and applicable record keeping requirements.

Where an enquiry does not result in the firm accepting an instruction, the information will generally be retained only for as long as reasonably necessary for the purposes for which it was received, including administrative and professional record keeping.

Information relating to unsuccessful employment or internship applications may be retained for a reasonable period, generally not exceeding one year, unless a longer period is required or permitted by law or the applicant asks us to delete it sooner.

Security

We take reasonable measures to protect personal information against unauthorised access, disclosure, alteration or loss.

These measures include appropriate access controls for our systems and reasonable physical security at our office. Access to information is limited according to the requirements of the relevant work.

No method of transmitting or storing information electronically can be guaranteed to be completely secure. We therefore cannot guarantee the absolute security of information transmitted to us through the internet.

The website itself does not operate as a repository for confidential client files.

Your rights

The Privacy Act, 2075 (2018), together with other applicable law, provides rights and protections in relation to personal information.

Subject to applicable legal restrictions, you may contact us to request access to personal information held about you or to request correction of information that is inaccurate.

Requests should be sent to info@slawnepal.com. We may need to verify your identity before responding to a request.

There may be circumstances in which information cannot be disclosed or amended, including where it forms part of a client file, is subject to legal privilege, confidentiality obligations or another legal restriction. Where such a restriction applies, we will explain the position to the extent we are able to do so.

Children

The website is intended for a general audience and is not specifically directed towards children under the age of 18.

We do not knowingly seek to collect personal information from children through the website. Where a legal matter concerns a minor, information will ordinarily be provided to the firm by a parent, guardian or other person authorised to act on the minor's behalf, subject to the circumstances and applicable law.

Changes to this policy

This policy may be updated when there are changes to the website, the way information is handled or the legal requirements applicable to us.

The date at the beginning of the policy indicates when it was most recently updated. We encourage visitors to refer to this page from time to time for the current version.
